By using MIOMIO in any capacity — pressing /start in the Bot, making a payment, or browsing the Website — you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.

02 Service Description

MIOMIO is an AI-powered creative platform that lets you generate stylized photos and videos from selfies. You choose a photo shoot style or a trending video template, upload your photo, and the AI produces the result.

The Service is delivered through a Telegram bot ("Bot") and a companion website ("Website").

MIOMIO is a creative and entertainment tool. It is not designed for identity verification, biometric analysis, document creation, or any purpose requiring guaranteed accuracy. Results are probabilistic and may vary.

The Service uses AI models to process facial features from the photos you upload. This processing is automated and is performed solely for the purpose of generating the requested creative output. No biometric templates are stored or used for identification purposes.

The models used may be updated or replaced at our discretion to improve service quality.

We may modify, add, or remove features at any time. We will endeavour to notify users of material changes through the Bot. The current set of available features is always shown in the Bot interface.

03 Eligibility & Your Account

To use MIOMIO you need a valid Telegram account, internet access, and must be at least 18 years old (or the minimum age required by the laws of your jurisdiction, whichever is higher). If we discover a user does not meet the age requirement, access will be revoked without notice.

You are fully responsible for everything that happens under your Telegram account in connection with MIOMIO. Do not share, transfer, or resell your account or purchased generation packs.

We may offer a limited number of free trial generations to new users. Availability and terms of the trial are at our sole discretion.

04 Generations, Pricing & Payments

How It Works

MIOMIO uses a generation-based model. You purchase a generation pack — a bundle of Generations — and spend them when you create an AI photo shoot or video. Each operation consumes one or more Generations; the exact cost is always shown before you confirm.

What Are Generations

Generations are digital goods with no intrinsic monetary value. They represent a prepaid right to use the Service. Purchased Generations do not expire, but may be discontinued if the Service shuts down (see Section 11).

Payment Processing

Payments are handled by third-party processors shown in the Bot. Prices and available packs may differ by region. We do not directly store or handle payment card data.

No Subscriptions

All purchases are one-time. There is no auto-renewal or recurring billing unless you explicitly opt in to a separate subscription offer.

05 Refund Policy

Since Generations are digital goods, the following rules apply:

To request a refund, email support@yourdomain.com with your Telegram username and payment details. We aim to process requests within 14 calendar days.

Consumer rights: Nothing in this policy limits your statutory consumer rights. If mandatory law in your jurisdiction provides greater protections (including the right to litigate in your local courts), those protections prevail.

06 Rules of Use

Prohibited Activities

You must not:

Photo Uploads

You may only upload photos of yourself or of people who gave you explicit consent. You are solely responsible for the legality of everything you upload.

Enforcement

We may restrict, suspend, or permanently ban your account if you violate these rules. In serious cases, remaining Generations are forfeited without compensation.

07 AI Results & Expectations

AI generation is probabilistic. Outputs may contain artifacts, distortions, or inaccuracies. We make no guarantee regarding quality, likeness, style, or any other aspect of the result.

Subjective dissatisfaction ("doesn't look like me", "wrong vibe") is inherent to AI creativity and is not grounds for a refund or claim.

You control the quality of input. Poor lighting, blurry photos, obstructed faces, or heavy filters will degrade results. We are not responsible for outcomes caused by low-quality reference materials.

08 Intellectual Property

All rights to MIOMIO — its code, design, algorithms, models, and documentation — belong to Ptichka Limited or are properly licensed.

To the extent permitted by applicable law, you retain rights to images you generate using the Service, including for commercial use, subject to third-party rights and legal restrictions in your jurisdiction. The legal status of copyright in AI-generated images varies by country; you are responsible for understanding the applicable rules before using generated content commercially.

By uploading photos, you represent that you have the legal right to do so and that no third-party rights are infringed.

What We Collect

Facial Data Processing

The photos you upload are processed by AI models to extract facial features necessary for generation. This data is used only to produce the requested output and is not used for identification, surveillance, or building biometric profiles. Processed facial data is not retained after generation is complete.

Purpose of Processing

Your data is collected for a lawful purpose directly related to the operation of the Service: processing generation requests, managing your account, providing support, and improving service quality. We will not repurpose your data without explicit consent.

Data Storage & Transfers

Your data is stored on servers located in __DATA_LOCATION__. Where your data is transferred to a jurisdiction outside Hong Kong, we take reasonable steps to ensure it remains protected to a standard comparable to the Personal Data (Privacy) Ordinance.

Security

We implement technical and organizational measures to safeguard your data against unauthorized access, loss, or misuse, including encryption in transit and at rest, access controls, and regular security reviews. However, no digital transmission or storage method is 100% secure.

Data Breach

In the event of a personal data breach that is likely to result in a real risk of significant harm, we will notify affected users without undue delay via the Bot or email where available, and will notify the Privacy Commissioner for Personal Data where required.

Your Rights

Under Hong Kong's Personal Data (Privacy) Ordinance (Cap. 486) you have the right to:

Cookies & Analytics

The Website may use cookies or similar technologies for basic functionality and analytics. No tracking cookies are used for advertising. You can disable cookies in your browser settings, though this may affect Website functionality.

Communications

You may receive service-related messages through the Bot (updates, support). To opt out of promotional messages, contact support.

10 Liability & Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind — express or implied — including merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, we are not liable for:

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the greater of: (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD 100.

Non-excludable liability: Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the laws of Hong Kong or your jurisdiction.

11 Termination

By you: Stop using the Service at any time. To delete your account and data, email support@yourdomain.com. Remaining Generations are forfeited upon deletion (refund rules in Section 5 still apply).

By us: We may suspend or terminate access at our discretion, with or without notice, for Terms violations or other reasons. Unused Generations may be forfeited.

If we shut down: We will make reasonable efforts to notify you at least 30 days in advance. Unused Generations are forfeited unless a refund is requested per Section 5.

12 General Provisions

Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify users at least 14 days before the new version takes effect via a message in the Bot. The current version with its effective date is always available on the Website. Continued use after the effective date constitutes acceptance.

Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region.

Disputes

Please contact support@yourdomain.com first — most issues can be resolved informally. Unresolved disputes fall under the jurisdiction of Hong Kong courts, except where mandatory consumer protection legislation in your jurisdiction grants you the right to bring proceedings in your local courts.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

Entire Agreement

These Terms, together with any policies referenced herein, constitute the entire agreement between you and Ptichka Limited regarding the Service.
